These Terms of Service apply to the Pinas Kart website at pinaskart.com.au and purchases made through the website.
Pinas Kart is operated by JSC STORES PTY LTD (ABN 50 618 394 960). In these terms, “Pinas Kart”, “we”, “us” and “our” refer to JSC STORES PTY LTD trading as Pinas Kart.
By accessing our website or placing an order, you agree to these terms and our published policies.
1. Online store
Our online store is hosted by Shopify, which provides the ecommerce platform used to offer our products and services.
You must use the website only for lawful purposes. You must not interfere with the website’s operation, security or other customers’ use of the service.
2. Products and availability
We make reasonable efforts to display product descriptions, images, sizes and prices accurately. Packaging and appearance may occasionally change without notice.
Products are subject to availability. We may limit quantities, correct genuine errors or discontinue products. If an ordered product is unavailable, we will contact you and arrange an appropriate substitution, replacement or refund.
Nothing in this section limits rights available under the Australian Consumer Law.
3. Prices and payment
Prices are displayed in Australian dollars. Applicable delivery charges are based on the delivery postcode and order value and will be presented through the ordering process.
Payment must be successfully processed before an order can be completed. We may correct genuine pricing or product-information errors. If an error affects an order already placed, we will contact you before proceeding where appropriate.
4. Orders
Submitting an order is an offer to purchase the selected products. An order is accepted when we confirm it.
Please check product selections, quantities, contact details and delivery information carefully before submitting an order. Contact us promptly if a correction is required. We cannot guarantee that an order can be changed after preparation has started.
We may decline or cancel an order where products are unavailable, payment cannot be processed, information appears incorrect, or accepting the order would be unlawful. If we cancel a paid order, we will provide an appropriate refund.
5. Local delivery and pickup
Pinas Kart currently offers local delivery to selected Sunshine Coast postcodes and local pickup from Coastal Spices in Caloundra.
Delivery areas, schedules, minimum order values, fees and free-delivery thresholds are explained in our Shipping Policy and Delivery & Pickup page.
Customers are responsible for providing complete and accurate delivery and contact information.
6. Damaged, incorrect or missing items
Please inspect orders promptly and contact us as soon as possible if an item is damaged, leaking, spoiled, missing or incorrect.
Our Return and Refund Policy explains the information required and the available resolution process.
Our policies operate in addition to, and do not exclude or limit, rights and remedies available under the Australian Consumer Law.
7. Privacy
Personal information is handled in accordance with our Privacy Policy.
Shopify may also process information necessary to provide the ecommerce platform and related services.
8. Website content and intellectual property
Unless otherwise stated, the Pinas Kart name, branding, website design and original website content belong to JSC STORES PTY LTD or are used with permission.
Website content may be used for personal shopping purposes. It must not be copied, republished, sold or commercially exploited without permission, except where allowed by law.
Product names, packaging and trademarks belonging to manufacturers or other third parties remain the property of their respective owners.
9. Third-party services and links
The website may contain links to services operated by third parties. Those services may have their own terms and privacy practices.
To the extent permitted by law, we are not responsible for independent third-party websites or services that we do not control.
10. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
Where liability can lawfully be limited, our liability will be limited only to the extent permitted by law.
11. Website availability
We aim to keep the website accurate, secure and available but cannot guarantee uninterrupted access. Maintenance, technical problems or events outside our reasonable control may temporarily affect availability.
Nothing in this section limits any responsibility that cannot be excluded under Australian law.
12. Changes to these terms
We may update these terms to reflect changes to the store, our practices or applicable law. Updated terms will be published on this page and will apply from their stated effective date.
Changes will not remove rights that already apply to an accepted order.

These terms are governed by the laws of Queensland, Australia. Courts and tribunals with jurisdiction in Queensland may hear disputes relating to these terms, subject to any rights customers have under applicable law.
